The Terms & Conditions (“Terms”) outlined here govern all transactions and use of services offered by Mellifera LLC (“company”). By accessing this website or utilizing its functions, including but not limited to purchase transactions, the customer agrees to these Terms. If the customer does not agree, they should exit the site and discontinue any use thereof. Any continued use of this site and its functions will be considered agreement to these Terms.
Mellifera LLC is a registered business in the state of Rhode Island, United States of America, Resale License #2-4442-8437, and complies with local and federal laws and regulations as applicable.
Use of Website
The customer has access and use of this website, specifically www.mellifera.com (“website”), only for lawful purposes, including personal shopping. All content, including but not limited to product descriptions, product images, company branding, trademarks, and copyrights, is owned exclusively by the company and may not be copied or used without written permission from the company. Anyone who violates these terms will be held accountable per the applicable local and federal laws.
Product Information
The company makes reasonable efforts to ensure product descriptions, pricing, and availability are accurate. Minor variations in color, size, or packaging may occur and do not constitute defects. The company also offers the customer multiple handmade artisan items for purchase, including but not limited to pottery, which may have major variations in color, size, and shape between individual pieces. The images, product descriptions, and sizing shown for these products are only a reasonable and generic representation what the customer may expect to receive; any differences do not constitute defects. All products are offered in limited quantities and may be changed, price adjusted, purchase amount restricted or discontinued at any time without prior notice.
Orders and Payment
All orders are considered pending until the company fulfills it. The company retains the right to decline or cancel part of or the entirety of an order for any reason, including but not limited to suspected fraud, payment issues, disregard of product limitations, or product unavailability. In the case of product unavailability, reasonable efforts will be made by the company to contact the customer to offer a similar product alternative or similarly priced alternative prior to taking any action to cancel the order. These reasonable efforts are subject to the discretion of the company. All prices are listed in USD (United States Dollar) unless otherwise noted. Taxes and shipping costs will be calculated at checkout when applicable.
Shipping and Delivery
Shipping times shown at checkout are estimates generated by the shipping carrier and may vary due to carrier delays, weather issues, customs processing, or events outside the company’s control. Risk of loss transfers to the customer once the order is handed to the carrier. The customer is responsible for providing accurate shipping information. The company will make reasonable efforts to ensure the order is packaged to prevent damage during transit, but is not liable for any shipping damage, incorrect or non-deliveries, deliveries left subject to natural elements that may cause damage, package theft, or any other issues that may arise once the order has been handed to the carrier.
Returns and Refunds
The company may offer returns or refunds according to the policy posted on the website at the time of purchase. Returned items must comply with the stated requirements. Shipping charges are non-refundable unless required by law.
International Orders
The company will ship internationally at its discretion. The company will only fulfill and ship to the countries listed in the shipping policy on the website at the time of purchase. Any warranty options included with a purchase are through the product manufacturer only and it is the responsibility of the customer to apply or register any warranties with the manufacturer and to file any claims that may arise under the manufacturer’s warranty with the manufacturer. Governing Law
These Terms are governed by applicable state and federal laws. Any legal dispute is subject to the arbitration agreement clause of these Terms and all legal actions will occur in the State of Rhode Island.
Arbitration Agreement
Any dispute or claim arising from the customer’s use of the website, any purchase from the company, or any communication with the company will be resolved through binding individual arbitration conducted by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will occur in Rhode Island unless both parties agree to a different location. The customer and the company waive the right to sue in court or have a jury trial, and the arbitrator may award any individual remedy a court could provide. Class actions, class arbitrations, collective actions, and representative claims are not allowed, and disputes must be handled individually. Either party may bring a qualifying claim in small claims court, and the company may seek injunctive relief in court to protect its intellectual property or prevent misuse of the website. Use of the website or its functions signifies agreement to this clause.
